These Terms of Service govern your use of the TMS Truck Sales website and any transactions entered into with TMS Truck Sales. By using this site or engaging with us, you agree to these terms.

1. Nature of Business

TMS Truck Sales is a South African commercial vehicle dealer operating from Plot 24, Clifford Road, Chancliff AH, Krugersdorp, Gauteng. We facilitate the sale of trucks, trailers, yellow equipment, and commercial vehicles.

2. Pricing and Availability

All prices displayed or quoted are exclusive of VAT unless stated otherwise. Prices and stock availability are subject to change without notice. A confirmed sale is only binding upon receipt of a signed agreement and deposit.

3. Export Sales

Cross-border and export transactions are conducted at 0% VAT in accordance with South African revenue law, subject to the provision of valid export documentation. Buyers are responsible for all import duties and compliance requirements in the destination country.

4. Vehicle Condition and Inspection

• All vehicles are sold as described. We strongly recommend physical inspection before purchase.
• We do not warrant the roadworthiness of vehicles unless explicitly stated in writing.
• Buyers are responsible for conducting their own due diligence, including verifying registration and NATIS records.

5. Trade-Ins

Trade-in valuations are offered at our discretion and are based on market conditions at the time of assessment. A confirmed trade-in value is only binding once issued in writing.

6. Liability

TMS Truck Sales shall not be liable for any indirect, consequential, or incidental losses arising from the use of this website or any transaction facilitated through it.

7. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of Gauteng.
